Strata Property Act Updates - EV Charging and Rental Restrictions

On April 6, 2023 the Government introduced Bill 22 – Strata Property Amendments Act, 2023 and Bill 24 – Miscellaneous Statutes Amendment Act (No. 2), 2023.  These Bills address EV charging and age restrictions in strata corporations, respectively.

 

Bill 22 and EV Charging

If passed, Bill 22 would amend the Strata Property Act to improve access to EV charging in residential strata buildings by:

Lowering the voting threshold from 75% to 50% approval for expenditures and changes to common and personal property that are needed to install EV charging stations.  
Requiring strata corporations to obtain an electrical planning report to help understand the building’s electrical capacity and plan for the expansion of EV charging stations.
Requiring strata corporations to approve owners’ requests to install EV charging stations, at the owner’s expense, if reasonable criteria are met.

Bill 24 and Strata Rental Restrictions

If passed, Bill 24 would clarify that not only can strata corporations not pass (on a go forward basis) bylaws setting a minimum age that is less than 55, but they also cannot enforce such bylaws they already had passed.  The amendment would be made retroactive to November 24, 2022, to hold harmless anyone facing enforcement action under an older invalidated age restriction bylaw since the changes were made to the SPA by Bill 44 (2022).
