Court appointed Administrators under the Strata Property Act

FEATURE PRESENTATION

  • Ever wondered what a Strata Administrator, under the Strata Property Act, does when appointed by the Supreme Court of British Columbia?
  • Does he or she replace the strata council?
  • Can an administrator usurp the voting rights of the owners generally?
  • Who does the appointed person report to?
  • How are they paid?

Administrators are not a frequent presence in strata corporations but over the past decade or so they have become more popular when the owners simply refuse to get along with each other. It is likely that we will see the use of administrators more and more in the coming years. It is a unique topic, one that generally does not fall into the conventional seminar circuit.

CCI Vancouver is pleased to be hosting a lunch and learn seminar on the topic of administrators and the guest presenter will be Gerry Fanaken.

Until his recent retirement as the CEO of Vancouver Condominium Services, Gerry practiced strata management for the past four decades. During that time he was appointed by the Supreme Court of BC as an administrator about a dozen times to sort out chaos in dysfunctional strata corporations. He has some fascinating stories to share with you about what it is like to work in that environment. And of course he will answer the questions above and many more that you may have.

Gerry always retained legal counsel to represent him in the various appointments and Jamie Bleay from the Access Law Group, and the President of CCI Vancouver, will also share with you at the seminar his unique perspective of representing a client caught in the snare of an appointment. Geoffrey Dabbs of the law firm Gehlen Dabbs represented Gerry in some of his appointments. He will also speak at the seminar to discuss some of the precedent setting court decisions that flowed from Gerry's work on some files.
